These General Terms and Conditions of Contract of the COOPERATIVE (hereinafter, “the General Conditions”) govern the access and use of the website accessible via the domain name https://grusco.cat/es/ (hereinafter, “the Website”), as well as the purchase and sale of cooperative products directly with the COOPERATIVE. Simple access to the Website confers upon the person accessing it the status of Website User (hereinafter, “the User”) and implies acceptance of all terms included in these General Conditions. Should the User not agree with these General Conditions, they must immediately leave the Website without using it.

User Registration
The use of the online store requires User registration on the Website. The User must register by providing their full name, email address, and phone number. Once registration is complete, a message will be sent to the designated email account with a link that the User must follow to confirm access to it. In any case, to finalize the purchase process, the User will be required to accept these General Conditions, as well as the Privacy Policy and the Cookies Policy. Once the User is correctly registered on the platform, they can access “My Account” at any time. Through “My Account,” the User can modify their personal data, as well as data related to order shipping, and check for pending deliveries. In the “My Account” section, the User can download order invoices and has the option to cancel the account at any time, indicating the reason for cancellation.
Shipping Conditions
The COOPERATIVE only ships its products within the European Community (EEC). It will not be possible to complete the purchase process through the Website for destinations other than those indicated. 2 Delivery will take place within 48/72 hours from receipt of payment for shipments to mainland Spain, excluding holidays. The delivery period to other areas, depending on the destination, may be delayed by an additional 7 days.
On special dates such as Christmas, Epiphany, or long weekends, delivery may not be guaranteed within the period indicated in the previous paragraph, due to the high volume of goods handled by transport companies.
During holiday periods, shipping may be delayed by 24 or 48 hours due to the high volume of pending shipments. In Spain, August is considered the summer holiday period.
The online store service is only available to private customers, who will be considered “consumers.”
The purchase of products through the platform on the Website is subject to shipping costs, payable by the buyer.
Actual shipping costs will be detailed throughout the purchase process, and the buyer will have the opportunity to review these costs before finalizing their purchase. The COOPERATIVE cannot be held responsible for delays in order delivery due to causes not directly attributable to the COOPERATIVE, unforeseen circumstances, or force majeure.
Products will be transported in packaging suitable for the protection and safety of the contents.
Orders will be delivered to the delivery address freely designated by the User, which may be their own or a third party's. The COOPERATIVE assumes no responsibility if product delivery cannot be made due to the inaccuracy or falsity of the data provided by the User for this purpose, or if delivery cannot be made due to reasons beyond the COOPERATIVE's control, such as the absence of the recipient at the delivery address.
In the event of the recipient's absence, and whenever possible, a delivery note will be left with the necessary information to arrange a new delivery at the recipient's address or instructions for the recipient to collect the product from a specific location. In any case, if 7 days have passed since the last delivery attempt without the order being delivered, it will be returned to origin and the contract will be terminated, with the buyer unable to claim any refund if the cause of non-delivery was attributable to the buyer.
Warranty and Responsibilities
The seller shall deliver to the consumer and user products that conform to the contract, in accordance with Article 116 of the General Law for the Defense of Consumers and Users, being liable to them for any lack of conformity existing at the time of delivery
of the product. In case of non-conformity of the product, the buyer shall have the right, within a reasonable period, to its replacement, and if this is not possible, to a proportional price reduction or termination of the contract, with the resulting costs borne by the cooperative.
The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to meet this deadline will not result in the loss of the right to the corresponding remedy, but the buyer will be liable for any damages actually caused by the delay in communication.
Product Selection by the User
Any registered User may contract for the purchase of products through the Website. The purchase process at the COOPERATIVE is based on a virtual cart, to which the User can add the products they wish to purchase.
To add products to the shopping cart, once the User is on the product description page and has selected the available customization options, they must select the “Add to cart” option provided. The User can access and modify the contents of the cart at any time.
Order Processing
Once the desired products are in the cart, the User can initiate order processing by selecting the cart, an option that will show the User the contents of the virtual cart, allowing modification of selected products and their removal from the shopping cart.
The User must ensure that the products displayed on the screen are those they wish to purchase and select the appropriate geographical area from the listed options for the shipping address. At this point, the total price of the selected products and the shipping costs are displayed
generated, as well as applicable discounts and the final VAT amount. By clicking “PROCEED TO CHECKOUT,” the User accesses a panel where they must enter shipping details to continue with the contracting process. The User must fill in the shipping information, including their full name, phone number, and address, completing all fields marked as mandatory. In this section, the User may include any useful information they deem necessary for the courier, although the COOPERATIVE cannot guarantee its fulfillment. If the User wishes the billing address to be different from the shipping address, they must check the box “My billing address is different from the delivery address” and fill in the corresponding information.
In the next phase of the purchase process, the User must select the payment method. At this point, the User is again shown the exact amount to pay, resulting from the sum of the product price, shipping costs, VAT, and applicable discounts.
Following the “PLACE ORDER” link will direct the User to the selected payment gateway. Once payment is successfully processed, the order will be automatically processed, confirming the order information on screen and sending an email to the User
confirming the operation. The corresponding invoice for their order will be made available to the user. In any case, they can contact the COOPERATIVE to request a copy of it via email. grusco@grusco.net
Product Prices and Payment Method
Product prices are those indicated in the description accompanying the photograph. All prices indicated in the product description are expressed in euros (€) and include Value Added Tax (VAT).
The following payment methods are established:
- Direct Bank Transfer.- Make your payment directly into our bank account. Please use your order reference as the payment reference. Your order will not be shipped until the amount has been received in our account.
- Payment by debit or credit card (VISA, MASTERCARD, and AMERICAN EXPRESS) via a virtual POS terminal.
To use a credit card via a virtual POS terminal, the buyer must fill out a form indicating the cardholder's name, card type, card expiration date, and security code.
The COOPERATIVE does not have access to the bank details linked to the payment methods and neither knows nor records this data during the payment operation.
Confirmation of Acceptance Receipt
Once the purchase process is complete, the User will receive, at the designated email address, the invoice for the purchased products, the selected shipping method, the order number, and the delivery date. Furthermore, a permanent link to these terms and conditions of contract will be sent to the email address provided by the User.
Right of Withdrawal.
Food products generally have a 14-calendar-day return right if purchased online. This is the usual period for any product purchased in e-commerce, however, in certain cases, the return of a food product will not be possible, for which reference should be made to Article 103 of the General Law for the Defense of Consumers and Users, specifically, letters c), d), and e) contain the most important exceptions. As well as the Commission's Guide on Consumer Directive 2011/83 EU, on which the current General Law for the Defense of Consumers and Users is based.
Product returns will always be made through transport agencies.
The User has a period of 14 calendar days from the receipt of the products to inform of the return of the products, in exercise of their right of withdrawal, and to return them to the seller, by sending an email to grusco@grusco.net, specifying “Withdrawal-Return” as the subject. The User must state their name and ID, order identification, the products they wish to return, and the payment method used.
The User may return product units that have not been tasted and are in perfect condition (not damaged, soiled, or opened by the User), properly protected, and preferably in their original packaging. After verification by the COOPERATIVE of the good condition of the products, the corresponding amount for the returned units will be refunded within a maximum period of 14 calendar days using the same payment method the User used for the initial purchase. This guarantee does not extend to the transport costs of the return, which will be borne by the User.
In any case, it is the customer's responsibility to verify that the merchandise has been delivered in perfect condition. Once the products subject to withdrawal have been received and their correct condition verified, the COOPERATIVE will refund the amounts paid by the User within a maximum period of 14 calendar days. Products that do not retain their original packaging may suffer depreciation. The COOPERATIVE will refund the amounts paid by the User. The cost of returning the product will be borne by the User.
To exercise the right of withdrawal, the user can also use the form made available on the Website.

Applicable Law and Competent Jurisdiction
These General Conditions shall be governed by and interpreted in accordance with Spanish law. The COOPERATIVE and the User agree to submit any dispute that may arise from the provision of products or services subject to these General Conditions to the User's domicile.
In the event that the user is considered a consumer, as an alternative to judicial proceedings, the COOPERATIVE and the user may agree to submit the generated dispute to the Consumer Arbitration System, as provided in Royal Decree 231/2008, of February 15, which regulates the Consumer Arbitration System, via this link https://www.consumo.gob.es/es/consumo/sistema-arbitral-consumo

The COOPERATIVE guarantees security and confidentiality in all its communications with its customers. All online payment operations, if they occur, are carried out through a secure server, based on the SSL standard that protects data against third-party violation attempts. The COOPERATIVE guarantees the protection and confidentiality of personal, address, payment, and any other data provided by our customers in accordance with current data protection regulations and the privacy policy published on the Website.
